Our privacy policy applies to all visitors, users, and others who use the services we provide via our websites Desygner.com, WeBrand.com and all our iOS and Android apps. We refer to all of these products as "Services" in this policy. If you do not agree with this policy, do not access or use our Services or interact with any other aspect of our business.

Any version of this Privacy Policy in a language other than English is provided for convenience. If there is any conflict with a non-English version, you agree that the English language version will control.

Where we provide the Services under contract with an organisation (for example your employer) that organization controls the information processed by the Services. For more information, please see Notice to End Users.

What this privacy policy covers

At Desygner we believe that the more we protect our users’ data the better. Your privacy is important to us, and so is making simple for you to understand how we collect, use and share information about you. Here is what this policy covers:

The information we collect about you

We collect information about you in 4 ways. When you voluntarily provide it to us, when you voluntarily give us permission to obtain, when other sources provide it to us, or when you use our Services.

1) The information you provide to us:

  • Personal Information: When you sign up to our Services, you provide us certain information, including your name, country, language, email address, how you intend to use our Services, or anything else you may be asked and decide to provide.
  • Personal Design Assets: When you create content using our Services, you may choose to upload images, icons, fonts, videos, files, as well as add textual content.
  • Business Information: Our Services can be used for business purposes. If you are authorized to create or manage an account on behalf of an organisation, you may choose to provide information related to that organisation.
  • Business Brand Assets: When you manage or create content for an organisation, you may choose to upload logos, images, icons, fonts, videos, files, as well as add textual content on behalf of that organisation.
  • Information you provide through our support channels: Our Services provide customer support channels, where you may choose to submit information regarding a problem you are experiencing. Whether you email us, open a support ticket, speak to one of our representatives directly or otherwise engage with our support team, you will be asked to provide contact information, a description of the problem you are experiencing, screenshots or information that would be helpful in resolving the issue.
  • Payment Information: In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. Your financial information will not be stored by us except for the name of the card holder, the expiry date and the last four digits of the Credit Card number. Subject to your prior consent and where necessary for processing future payments, your financial information will be stored in encrypted form on secure servers of our reputed payment gateway service provider who is beholden to treating your personal information in accordance to the General Data Protection Regulation (GDPR) (EU) 2016/679 and this Privacy Policy Statement.

2) Information you give us the permission to obtain:

You or the administrator of a business account may give us permission to access information from third-party services. For example, you may want to connect your Facebook, Instagram, Google Drive or DropBox accounts to our Services, which allows us to access, display and store files from those accounts as authorized by you. You may also choose to create an account or login using your Google or Facebook credentials, so we will receive your name and email address as permitted by your profile settings in order to authenticate you. You can also authorize us to synchronized a contact list, so that you can easily connect with those contacts within our platforms. The information we receive when you link or integrate our Services with a third-party service depends on the settings and privacy policy controlled by that third-party service. You can check the privacy settings and notices in these third-party services to understand what data may be shared with us.

3) Information we receive from other sources:

Other users of the Services: Other users of the Services may provide information about you. For example, we may receive your email address from a user when they provide it in order to invite you to the Services. Similarly, an administrator of an organisation may provide information they may find useful for content creation, for example, they may provide us with your name, email address and telephone number, so that a business cards can be easily created with your details.

Partners: We work with partners who provide consulting, implementation, training around the Services we offer. Some of these partners also help us to market, promote and resell our products. We receive information from these partners, such as billing information, contact information, company name, what services you purchased or may be interested in, evaluation information you have provided, events you have attended, and what country you are in.

Advertising Partners: We receive information about you and your activities on and off the Services from third-party advertising partners who provide us with information about your interest in and engagement with our Services and online advertisements.

4) When you use our services:

Usage Details: Your usage details such as time, frequency, duration and pattern of use, features used and the amount of storage used will be recorded by us in order to enhance your experience of the Services and to help us provide you the best possible service.

Device Information: We also collect information about the device you're using the Service on, including what type of device it is, what operating system you're using, device settings, unique device identifiers, and crash data. Whether we collect some or all of this information often depends on what type of device you're using and its settings. For example, different types of information are available depending on whether you're using a Mac or a PC, or an iPhone or an Android phone.

Cookies: Like many websites we may use "cookies" - a small data file that is transferred to your computer's hard disk - or similar technologies to record log data. When we use cookies, we may use "session" cookies (that last until you close your browser) or "persistent" cookies (that last until you or your browser deletes them). For example, we may use cookies to store your settings so you don't have to set them up every time you visit our website. Most Internet browsers automatically accept cookies. How your information is used

In a nutshell, we use the information we collect to provide the Service, to make our products better, to develop new products and to protect our users. More specifically we use your information to:

Provide the Services: During the Registration Process for creating a user account to use our Services, we request for your name and email address. You will also be asked to choose a unique password, which will be used solely for the purpose of providing access to your user account. We use information about you to provide the Services to you, including to process transactions with you, authenticate you when you log in, provide customer support, operate and maintain the Services. For example, we use the name and picture you provide in your account to identify you to other Service users. Our Services also use the assets you upload to allow you to create content using those assets.

Provide a personalized user experience: We use your information to offer tailored features that personalize your experience and offer you customized content. For example, we may use your industry to return marketing materials we think are relevant.

Send you notifications related to your account: Our Services use the information we collect to send you updates on company activities (such as invitations to be part of an organisation, campaigns that become available, information regarding campaigns or designs created by you), connections and recommendations that are most relevant for you and/or your team. Where you use multiple Services, we combine information about you and your activities to provide an integrated experience, such as to allow you to find information from one Service while searching from another or to present relevant product information as you travel across our websites. You can control whether you receive non-contractual communications as described below under "How to opt-out".

Communicate with you: Your name and email address will be used to inform you regarding new services, releases, upcoming events and changes in this Privacy Policy Statement. You can control whether you receive non-contractual communications as described below under "How to opt-out".

Make the Services safer: We use information security tools (e.g., secured networks and encryption) in order to protect your personal information.

To protect our legitimate business interests and legal rights: Where required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business.

Address issues: We automatically log data about system failures. For example, we log our native app crashes, so that our developers can address them. We may also automatically track problems with the content we provide on the platform. This data is used anonymously and we will not check any content created in our platform, unless you give us the consent to do so.

Improve the Services: We are always looking for ways to make our Services smarter, faster, secure, and useful to you. We use collective learnings about how people use our Services and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement of the Services. In some cases, we apply these learnings across our Services to improve and develop similar features or to better integrate the services you use. We also test and analyze certain new features with some users before rolling the feature out to all users.

Legal basis for processing (for EEA users)

If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal basis for doing so under applicable EU laws. The legal basis depend on the Services you use and how you use them. This means we collect and use your information only where:

  1. We need it to provide you the Services according to our Terms of Services. This includes to operate the Services, provide customer support, offer personalized features, as well as protect the safety and security of the Services;
  2. It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Services and to protect our legal rights and interests;
  3. You give us consent to do so for a specific purpose; or
  4. We need to process your data to comply with a legal obligation.

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or the business organisation your account is connected to (e.g. your employer) have a legitimate interest to do so, you have the right to object to that use, though in some cases, this may mean no longer using the Services.

When & how your information is disclosed

We assure you that the contents of your user account will not be disclosed to anyone and will not be accessible even to employees of Desygner Pty Ltd except in circumstances specifically mentioned in this Privacy Policy Statement and Terms of Services. We also do not scan the contents of your user account for serving targeted advertisements.

We offer content creation tools, and we want them to work well for you. This means sharing information through the Services and with certain third parties. We share information we collect about you in the ways discussed below, including in connection with possible business transfers.

When we have your consent: Our Services offer tools for content creation, which means that you may choose for some of your content to be publicly available on our websites and the web. You can confirm whether certain Service properties are publicly visible from within the Services or by contacting the relevant administrator. Our services also offer sharing features to other services such as Facebook, Twitter or LinkedIn, and you or your organisation may choose publish content on them. With your consent, we may also post testimonials on our website, which may include names and other personal information.

For collaboration purposes: You can create content, which may contain information about you, and grant permission to others to see, share, edit, copy and download that content based on settings you or your administrator (if applicable) select. Some of the collaboration features of the Services display some or all of your profile information to other Service users when you share or interact with specific content.

When we have the consent of your organisation: If you register or access the Services to create content on behalf of an organisation that is not owned by you, certain information about you including your name, profile picture, contact info, content created and use of your account may become accessible to that organization’s administrator and other Service users sharing the same domain. If you are an administrator for a particular site or group of users within the Services, we may share your contact information with current or past Service users, for the purpose of facilitating Service-related requests.

When we need assistance from third-parties: We may employ third party companies or individuals to process personal information on our behalf based on our instructions and in compliance with this Privacy Policy. For example, we may share data with a security consultant to help us get better at identifying spam or with our accountants in the event of an audit. We may also use a customer service application to process our customer requests or manage business accounts. Any third-party with access to personally-identifiable information are beholden to treating your personal information in accordance to the General Data Protection Regulation (GDPR) (EU) 2016/679.

For legal reasons: We may disclose information If we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or Desygner; or to detect, prevent, or otherwise address fraud, security or technical issues.

In the event of business transfers: We may share or transfer information we collect under this privacy policy in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the Services if a transaction takes place, as well as any choices you may have regarding your information.

For analytics purposes: We may also share aggregated or non-personally identifiable information with our analytics partners. We may also choose to share aggregated information publicly to show trends about the general use of our services.

To manage and improve our advertising efforts: We partner with third parties to manage our advertisements on other sites. Our third party partners may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests. You can control this as described under "How to opt-out".

To serve ads on certain products: We may allow third-party ad servers or ad networks to serve advertisements on the Service, and provide them with certain information such as your location, browser and cookie data and other data relating to your use of our Service to deliver advertisements ("ads") that may be of interest to you. These third-party ad servers or ad networks use technology to send, directly to your browser or mobile device, the ads and ad links that appear on the Service, and will automatically receive your IP address when they do so. Desygner does not sell, rent, or share the information we collect directly from you. An advertiser may ask us to show an ad to a certain audience of Users (e.g., based on demographics or other interests) and in that situation, Desygner will determine the target audience. If you respond to such an ad, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach.

How your information is stored, secured & transferred internationally

We use AWS as our data hosting service provider internationally who is beholden to treating your personal information in accordance to the General Data Protection Regulation (GDPR) (EU) 2016/679 and this Privacy Policy Statement.

We use technical measures to secure your data and in order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account.

While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.

We may retain and use your personal information and data as necessary to comply with our legal obligations, resolve disputes, and enforce our rights. If you have a personal account and have requested account deletion, we will delete your information within 72 hours. If the Services are made available to you through an organisation (e.g., your employer), we retain your information as long as required by the administrator of your account. For more information, see "Notice to the End User".

Controlling your information

You can exercise choices regarding your information by logging into the Services and using settings available within the Services or your account as described below. For all other requests, you may contact us as provided in the Contact Us section below to request assistance.

Profile information: Access and change information in you profile at any time. If you have a personal account you can choose whether your profile is public (anyone can follow you) or private (people will have to request your permission to follow you). If your account is linked to an organisation, your profile will be public to the organisation users as specified by the company administrators as per "Notice to End Users".

Content Privacy: If you have a personal account, you can choose if the content you create is visible only by you (and the people you choose to collaborate with), by your followers or by everybody. If the Service you are using does not offer an option to change the content privacy, the content will be private by default. If your account is linked to an organisation, the content you create on behalf of that organisation may be visible to the organisation users as specified by the company administrators even if marked as private as per "Notice to End Users".

Content Information: You can also modify information on the content created using the platform at any time. However if your account is linked to an organisation, the content created on behalf of that organisation, the changes you make may be visible to the organisation users as specified by the company administrators as per "Notice to End Users"

Unlink your account to third-party apps: Where you have asked us to share data with third parties, for example, by installing third-party apps, you will need to contact those third-party service providers directly to have your information deleted or otherwise restricted. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.

Deactivate your account: You can choose to deactivate your account at any time. You may also choose to delete all your information completely. See "The right to be forgotten" for more details.

Opting out

From email notifications: You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Service account settings menu, or by contacting us as provided below to have your contact information removed from our promotional email list or registration database. Even after you opt out from receiving promotional messages from us, you will continue to receive transactional messages from us regarding our Services. You can opt out of some notification messages in your account settings.

From organisation email notifications: You may opt out from receiving emails from organizations you have joined for businesses purposes. These emails are not triggered by us, but by the company who uses our Services.

From push notifications: You can disable push notifications from us through your device & browser settings.

From cookies: If you would like to set your browser to refuse cookies, check your browser’s help information or visit the following links for further information: Aboutcookies.org, Chrome, Firefox, Edge, Safari.

From retargeting advertising: You may be able to opt out of receiving personalized advertisements from other companies who are members of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising. The right to be forgotten

We have made very easy for you to delete your information. All our products feature a "delete me" button under your account settings. If you have a personal account, you can simply click delete account, and all your information will be deleted within 72 hours. If your account is linked to an organisation, we may have to request their permission first, see "Notice to the end user".

Extracting your information

All content created using our platform can be exported as JPEG, PNG or PDFs. Original files can simply be downloaded as is. Should you request it, we can also provide you with a CSV file with all the information we stored regarding your account.

Other important information

Children’s information: The Services are not directed to individuals under 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information. If you become aware that a child has provided us with personal information, please contact us.

Policies Changes: We may change this policy from time to time, and when we do, we will revise the updated date at the top of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. If you continue to use our Services after those changes are in effect, you agree to the revised policy. If the changes are significant, we may provide more prominent notice or obtain your consent as required by law.

Links: Please note that content created and displayed through our Services may contain links to third party websites. We hereby disclaim any liability in relation to the privacy practices of other websites.

Notice to End Users

Many of our products are intended for use by organizations. Where the Services are made available to you through an organisation account (e.g. your employer, supplier or client), that organisation is the administrator of the Services and is responsible for the accounts and/or Service sites over which it has control.

If this is the case, please direct your data privacy questions to your administrator, as your use of the Services is subject to that organization's policies. We are not responsible for the privacy or security practices of an administrator's organization, which may be different than this policy.

Administrators are able to:

  • View and disclose content you created or uploaded on the account.
  • Modify and take ownership of content you created/uploaded on the account.
  • Require you to reset your account password;
  • Restrict, suspend or terminate your access to the Services;
  • Access information in and about your account;
  • Access or retain information stored as part of your account;
  • Install or uninstall third-party apps or other integrations

In some cases, administrators can also:

  • Restrict, suspend or terminate your account access;
  • Change the email address associated with your account;
  • Change your information, including profile information;
  • Restrict your ability to edit, restrict, modify or delete information

Even if the Services are not currently administered to you by an organisation, if you use an email address provided by an organization (such as your work email address) to access the Services, then the owner of the domain associated with your email address (e.g. your employer) may assert administrative control over your account and use of the Services at a later date. You will be notified if this happens.

If you do not want an administrator to be able to assert control over your account or use of the Services, use your personal email address to register for or access the Services. If an administrator has not already asserted control over your account or access to the Services, you can update the email address associated with your account through your account settings in your profile. Once an administrator asserts control over your account or use of the Services, you will no longer be able to change the email address associated with your account without administrator approval.
